Product Agreement

1. Overview

This Hosting Product Agreement ("Agreement") is between ServersCity ("we," "us," or "our") and the individual or entity ("you," "your," "Customer") purchasing hosting services ("Services") from ServersCity. By purchasing or using our services, you agree to the terms outlined in this Agreement.

2. Hosting Services

We provide dedicated server and shared hosting services. The features and scope of the services you receive are based on the hosting plan you choose. ServersCity will make reasonable efforts to maintain uptime and security as outlined in our Service Level Agreement (SLA), which is available upon request.

3. Service Availability and Uptime Guarantee

ServersCity guarantees 99.9% uptime for our hosting services, except in cases of scheduled maintenance, force majeure events, or factors outside of our control. Downtime caused by user actions or third-party software is not covered under this guarantee.

While ServersCity makes efforts to backup customer data, we do not guarantee the integrity or availability of these backups. It is the customer’s responsibility to ensure that all data is properly backed up and secured. ServersCity is not liable for data loss due to hardware failures, security breaches, or any other reasons.

7. Termination and Suspension

We reserve the right to terminate or suspend your hosting services under the following conditions:

Upon termination, you will no longer have access to your data stored on our servers. It is your responsibility to ensure that any necessary backups are made prior to termination.

8. Limitation of Liability

ServersCity is not responsible for any indirect, incidental, or consequential damages, including but not limited to data loss, business interruptions, or loss of revenue, arising from the use or inability to use the services. Our maximum liability to you for any claim shall not exceed the amount paid by you for the services in the six months preceding the claim.

9. Intellectual Property

All intellectual property rights related to the services, including software and documentation, remain the property of ServersCity or our licensors. You may not reverse-engineer, copy, or distribute any part of the services without our explicit permission.

10. Modifications to the Agreement

We reserve the right to modify this Agreement at any time. Changes will be posted on our website, and continued use of the services after such changes constitutes your acceptance of the updated terms.
